Uninsured motorist coverage

Throughout Illinois, insurance companies are required by law to offer policyholders uninsured motorist coverage (sometimes abbreviated UM). Uninsured motorist coverage is an extension of your own insurance policy that allows you to collect certain compensation when liability insurance does not cover the person at fault. In particular, UM protects you in the following situations:

  • When the driver responsible for the accident has no insurance of his or her own
  • In hit-and-run accidents, when you are unable to identify the driver at fault
  • If an accident is caused by a driver operating a stolen vehicle (in which case he or she is not covered under the insurance policy belonging to the vehicle owner)

Uninsured motorist coverage is fairly inexpensive, and offers limits that are at minimum $20,000 per person or $40,000 per accident, but the limits can be more, depending on your policy. Moreover, without UM, you can be left severely injured from an accident that was not your fault while having to deal with large medical expenses, lost wages, and disability costs. While UM applies to these costs, as well as pain and suffering, it should be noted that costs of vehicle and other property damage are not typically covered.

How it works

To utilize your uninsured motorist coverage, you need to file a claim against your own insurance company, as if they were the at-fault driver who caused your injury. While these types of claims often proceed to arbitration, they are also typically easier to settle than those against another insured driver, particularly when you have an experienced attorney by your side.
